The revisions will eliminate constitutional and jurisdictional issues. On second reading, an amendment to the littering provision of the ordinance has changed allowing prosecution for littering for publishers or owners of publications leaving newspapers or other similar items on private property without a proper delivery receptacle.
Staff recommends approval.
There is little to no financial impact if these revisions are made. There could be fines imposed for violation of the new littering provision, up to $1,000.00 per day, but more likely a fine would range from $100.00 to $150.00 per violation. |
