Consider a motion to deny liability to Quindis Flemister, including denial of his Offer of Compromise in the amount of $275,000, based upon incident occurring April 28, 2016 involving former Griffin Police Officer Joshua Howell. See copy of ante litem notice and Police Incident Report attached. Based upon citizen complaints, Officer Howell was placed on administrative leave on 5/2/16 and resigned from City employment on 5/3/16. Investigation by the Georgia Bureau of Investigation remains pending.
Staff recommends denial of claim and rejection of Offer of Compromise in order to allow Plaintiff to move forward with litigation, if that is his desired intent. The claim has already been filed with GIRMA.
Under its GIRMA Member Coverage Agreement, the City has a $25,000 deductible per claim if litigation ensues. | | | |
