Consider motion to approve execution and delivery of quitclaim deed to Griffin Manor, LLC and DEC Family, LP, for an unopened strip of variable width running from S. 8th Street westward between these adjoining properties, believed to be a service alley. City Attorney Drew Whalen will address.

Mrs. Betsy Byrd, managing member of Griffin Manor, LLC, has requested the City abandon any interest it may have in an unopened service alley, varying in width from 5' to 8', lying between her property and that of DEC Family, LP (David's Drugs). Griffin Manor is in the process of demolishing the old hospital building in order to construct an expansion of assisted living facilities, added parking and a driveway onto S. 8th. David Clements concurs in her request and has negotiated an easement to allow use of the proposed driveway.
Approval. Investigation suggests this is an uncut service alley, originally platted for use of adjoining properties to provide alternate access in the rear. There is no evidence the City ever opened or maintained this strip, nor that public access was ever intended.
