ITEM SUMMARY:

Consider adoption on second reading of an Ordinance amending the Code of Griffin at Chapter 42, ENVIRONMENT, Article III, SOIL EROSION & SEDIMENTATION CONTROL, by incorporating new provisions added to State law at the 2016 Session of the General Assembly. Brant Keller, Director of Utilities, and City Attorney Drew Whalen will address.


SPECIAL CONSIDERATIONS OR CONCERNS:

The City of Griffin is designated as a "local issuing authority" for plan approval and permits to engage in land-disturbing activities regulated under the Georgia Soil Erosion & Sedimentation Control Law, OCGA Title 12, Chapter 7. As an LIA, the City must adopt an ordinance that is at least as stringent as the State law. After each revision of the State law, the City is required to update its ordinance and submit the newly-adopted ordinance to EPD to show compliance.

FINANCIAL IMPACT:

None - State law provides for a fee based upon the area of disturbance that is split between the LIA and EPD. Virtually, every development project requires a Soil Erosion, Sedimentation & Pollution Control Plan and permitting.
