| AGENDA ITEM SUMMARY
Consider a motion to deny the Offer of Compromise in the ante litem notice, dated June 16, 2016, from attorney Dorian Murry, on behalf of Rhonda Berry & Annie Jester, arising from a collision with a Griffin Police vehicle occurring on May 5, 2016. City Attorney Drew Whalen will address.
SPECIAL CONSIDERATIONS OR CONCERNS: |
On the morning of May 5, 2016, Griffin Police Officer Emily Blackmon, driving a City police unit, pulled from the gas station at North Expressway and Waterworks Street, onto the North Expressway, into the path of the vehicle driven by Rhonda Berry. Her mother, Annie Jester, was a passenger in the car. Although property damage was relatively minor, both ladies contend personal injuries and have made demand, through an Offer of Compromise, in the amount of $100,000 each. GIRMA has already settled the property damage claim.
Without an admission or denial of liability, expressly reject the proposed Offers of Compromise with claimants. This will allow the claimants to proceed with litigation if the claims are not settled.
Subject to the City's per claim deductible, GIRMA will provide a defense and pay any resulting judgments up to the limits of coverage. | | | |
