ITEM SUMMARY:

Consider approval on first reading of an Ordinance establishing the term of the office of Municipal Court Judge at one (1) year, commencing January 1 of each year, or until a successor is appointed; establishing the compensation for the office; and removing the Commission's power to remove the Judge without cause. City Attorney Drew Whalen will address.


SPECIAL CONSIDERATIONS OR CONCERNS:

Act 433 (HB 691) of the 2015-2016 Regular Session, effective July 1, 2016, now requires the office of Municipal Court Judge to be for a fixed term of at least one year; for the compensation to be established in advance of appointment; to designate whether the office is full-time or part-time; and providing terms and procedures for removal for cause only. The proposed ordinance will conform to this law, with an initial term commencing July 1, 2016 through December 31, 2016.

STAFF RECOMMENDATION:

Staff recommends approval.

FINANCIAL IMPACT:

Compensation is based upon the attached request from incumbent Judge Bill Johnson, whose letter is attached. This salary is included in the proposed FY17 Budget.
