ITEM SUMMARY:

Consider, on first reading, approval of an Ordinance amending the Code of Griffin, Georgia, at Chapter 46, FIRE PREVENTION & PROTECTION, by enacting a new Art. 5, CONSUMER FIREWORKS; SPECIAL USE PERMITS, commencing with new Sec. 46-60. City Attorney Drew Whalen will address.


SPECIAL CONSIDERATIONS OR CONCERNS:

The 2016 General Assembly amended the statewide law on Consumer Fireworks passed in the 2015 Session. The bill, HB 727, was signed into law on April 26, 2016 as Act 330, and became effective upon the Governor's signature. This law substantiallly changes the hours and locations where the use and ignition of fireworks in lawful, but still gives little discretion to local governments to regulate. One provision allows a Special Use Permit to be enacted, by ordinance, to additional hours and added limited locations.

STAFF RECOMMENDATION:

Staff recommends approval of the Ordinance.
