ITEM SUMMARY:

Consider, on second reading, an Ordinance amending the Code of Griffin at Chapter 2, ADMINISTRATION, and the Unified Development Code at Article 4, PROCEDURES, by clearing stating the City's intention to not discriminate on any cognizable basis in its service delivery, including the approval of licenses, permits, and other regulatory approvals. City Attorney Drew Whalen will address.


SPECIAL CONSIDERATIONS OR CONCERNS:

The U.S. Supreme Court's decision last Summer in REED v. TOWN OF GILBERT requires government regulations that impact a Constitutional right to be fair and administered in a non-discriminatory manner. If content based, there must be a compelling government interest for the regulation. One of the subtle elements addressed in this case was the local favoritism shown to some applicants while others were held in disfavor. This ordinance, patterned on a model suggested to local governments by IMLA last Fall, restates the City's policy of non-discrimination, to fairly administer government services, without favor or disfavor, to applicants. It should also serve as guidance to staff and a reminder that government action needs to be justified by a rational interest or need. There have been no changes since first reading on January 26, 2016.
