ITEM SUMMARY:

Consider, on second reading, an Ordinance amending the Code of Griffin, GA a Chapter 78, STREETS, SIDEWALKS & OTHER PUBLIC PLACES by enacting a new Article IV, UTILITY ACCOMODATION POLICY AND ISSUANCE OF RIGHT-OF-WAY PERMITS. City Attorney Drew Whalen will address.


SPECIAL CONSIDERATIONS OR CONCERNS:

The public rights of way within the City are valuable assets. While they primarily provide space for public streets and highways, rights of way (ROW's) also are the location for public infrastructure (water, sewer, stormwater, electric) and accomodate many public utilities (telephone, cable tv, internet, data services). This ordinance adopts the GDOT Utilities Accomodations Manual and also establishes the procedure for permitting ROW use and occupancy. There have been no changes since first reading on January 26, 2016.

STAFF RECOMMENDATION:

Approval. At this time the City has received an application for a ROW permit from a telecom company that wants to establish a fiber base within the City, for lease to an active telecommunications provider. These companies, known in the industry as "backhaulers", own the fiber network but provide no direct services.

FINANCIAL IMPACT:

ROW's also provide a potential revenue source to cities from utility installations within the ROW and pole attachment agreements.
