AGENDA ITEM SUMMARY
Consider approval of General Release and Indemnification agreement between Jessica Owens and the City of Griffin for personal injuries incurred in a motor vehicle accident occurring December 17, 2012 and which forms the subject of Civil Action File No. 14V-1804, Spalding Superior Court. City Attorney Drew Whalen will address.

On December 17, 2012, the vehicle operated by Jessica Owens, in which her 2 minor children were occupants, had stopped on Williamson Road in order to make a left turn into the children's daycare, when struck from the rear by a City owned truck operated by an employee. Ms. Owens suffered severe back injuries in the collision and has incurred substantial medical costs. She has been diagnosed as permanently partially disabled. Lawsuit has been defended by GIRMA and recommended settlement is $210,000.00.
Both children were in child restraint seats and not injured in the accident, but were checked out and have provided separate medical releases.
Approval
This claim is defended through the City's participation in the Georgia Interlocal
Risk Management Agency. The City's total risk exposure is $25,000 per occurrence. |
