In this lawsuit Plaintiff alleges officers of the Griffin Police Department violated her Fourth and Fourteenth Amendment rights during a traffic stop and subsequent search of her vehicle and person. The officers contend she voluntarily consented to the search, which Plaintiff denies, and the burden of proving a search was consensual and the scope of the consent clearly rests on Defendants. This Settlement Agreement, for consideration of $15,000.00, makes no admission of liability on behalf of the City or its officers, and is entered to compromise a disputed claim.
Staff recommends approval.
This claim was turned over to GIRMA for defense of the City and its officers. GIRMA provides coverage of $1,000,000 per occurrence, subject to a retention of $25,000 per occurence by the City (City's liability retention is budgeted). | | | |
