ITEM SUMMARY:

Consider motion to deny Notice of Claim from Law Offices of LaQuetta S. Pearson, P.C. given on behalf of Jemarko Parker, by letter dated June 23, 2015, purporting to comply with statutory ante litem notice requirements of O.C.G.A. Sec. 36-33-5. City Attorney Andrew J. Whalen, III will address.


SPECIAL CONSIDERATIONS OR CONCERNS:

Mr. Parker contends personal injury arising from an incident on June 11, 2015, as Griffin Police Officer James Waddell was backing his police car, owned by the City, at Griffin Crossings, 1597 W. McIntosh Road, out of a parking space. Officer Waddell's police car collided with the driver's side of a vehicle driven by Mr. Parker and owned by Roy Lee Harrell, Jr. Minor damage was done to the police car's right rear bumper, but the contact scraped the driver's side of the other vehicle. Mr. Parker reported no physical injury at the scene, but now reports a contusion to his left shoulder.

STAFF RECOMMENDATION:

Denial; filing of the notice tolls the statute of limitations until the City's governing body responds. Denial will allow the statute to recommence. The claim has been filed with GIRMA which is investigating.

FINANCIAL IMPACT:

The City has a $25,000 per occurrence deductible and limits of $1,000,000.00 under its GIRMA Member Coverage Agreement.
